Terminology
These rules and regulations (the "Rules")
apply to membership in the EnglishGathering.co.uk
Points Program (the "Program") and incentive
rewards earned by Primary Members ("Member(s)",
"you" or "your") of the EnglishGathering.co.uk
web site owned and operated by Gathering the
Anglo-Saxon Diaspora Limited ('EnglishGathering.co.uk',
'our', 'us' or 'we'). "Primary Members" are
defined as those members who have registered
an EnglishGathering.co.uk membership account in
their own names and NOT as Secondary Users
for another Member. "Secondary Users" are
defined as those Members who have been
registered on the EnglishGathering.co.uk web site
by a Primary Member with "view" and/or
"edit" access rights to the Primary Member's
account. References to EnglishGathering.co.uk
include its subsidiary and parent companies,
any subsidiary of any of its parent
companies and any person to whom we transfer
any of our rights or obligations under the
Rules.
These Rules are an agreement between you
and EnglishGathering.co.uk. From time to time we
may change the Rules. Changes to the Rules
will be posted on the the EnglishGathering.co.uk
web site. You are responsible for reviewing
the Rules and being aware of any changes.
General Terms
1.Accruing Points
Each Member may earn EnglishGathering.co.uk
points ("Point(s)") by entering data
on the
EnglishGathering.co.uk web site. Points will be
awarded based on the Activity table above.
The EnglishGathering.co.uk web site will show
your available Points earned after the
activity is recorded. Points accumulate indefinitely. They
are not cancelled at the end of any
year. Although the EnglishGathering Points
system is only being launched in June
2010, all existing members will have
their Points calculated and applied
retrospectively. Secondary Users do not
accumulate Points for their own membership
accounts and any Eligible Activities (see
note 2 below) carried out by Secondary Users
are applied to their Primary Member's
account instead.
2.Eligible Activities
'Eligible Activities' only include
legitimate data inputs for the purposes of
recording your family information using your
EnglishGathering.co.uk Membership account and of
the types listed in the Activity table
above. All Member activities are subject to
review and verification by
EnglishGathering.co.uk. Activities performed by
Members or Secondary Users which are clearly
intended solely for the purposes of
accumulating Points and which have no
legitimate historical or genealogical
values, will result in our removal of that
Member's Points by us. We reserve the right
to withdraw any Points issued for these or
any other activities we deem to be
ineligible. Any Member or Secondary User who
is found to be persistently carrying out
activities solely for the purposes of
accumulating points, will have their
Membership account cancelled by us.
3.Redeeming Points
Points can only be redeemed against
prizes offered to the Member by
EnglishGathering.co.uk. Each prize will have a
Sterling monetary value assigned by
EnglishGathering.co.uk. Each single Pound value
unit equates to one Point, so if a prize is
deemed to be worth £100.00, then the
Points value will be 100. Prizes will
be offered to Members on the basis of a
random draw. Members will be eligible for
the draw if the points value of the prize is
less than or equal to the Member's
accumulated points total. For example, if a
prize has a points value of 100, then any
Member who has an accumulated Points total
of 100 or more, will be eligible for the
draw. Prize draws will be held on dates
determined by EnglishGathering.co.uk and
EnglishGathering.co.uk reserves the right not to
hold any draws. Winning Members will be
notified by email. If the winning Member
decides to accept the prize, the prize
points values will be redeemed against their
total accumulated points and the prize
points value will be deducted from their
total accumulated points. If the winning
Member declines to accept the prize, then
the Member's total accumulated Points value
will remain unchanged. Prizes offered to
Members cannot be converted to cash. Members
have 30 days from the date of their email
notification to accept any prizes offered.
If the prize is not accepted within that
time, the offer will expire.
4.Points Restrictions
Points have no cash value, are
non-negotiable, and cannot be redeemed for
any benefit except for prizes offered, if
any. Points are not the property of you or
any other person and may not be brokered;
bartered; attached; pledged; gifted; sold,
or transferred under any circumstances,
including, but not limited to: disability;
death; upon operation of law, or in
connection with any legal proceedings. Your
Points may not be combined with anyone
else's Points and Points cannot be
transferred between Members. You are
responsible for determining any tax
liability arising from your participation in
the Program.
5.Membership Eligibility
Your membership in the Program will
commence with your Membership registration.
If you or EnglishGathering.co.uk terminate or
close your Membership Account, any points
that have not been redeemed ('Unused
Points') will be forfeited. If you or any
other person(s) acting with your permission
or acquiescence engages in any act of fraud,
any breach of these Rules and/or any breach
of the Eligible Activities Terms, we may (a)
disqualify you from participation in the
Program, and/or (b) refuse to award or
permit redemption of Points, and in either
case any Unused Points will be forfeited.
Employees and officer's of
EnglishGathering.co.uk, our agents,
sub-contractors and sponsors will not be
eligible for membership of the program.
6.Termination
We may, in our sole and absolute
discretion, withdraw the entire Program or
remove the Program from selected Members, by
giving 30 days prior written notice of our
decision, in which case any Unused Points
under the withdrawn Program or accrued by
the selected Members (as the case may be)
will be immediately and irrevocably
forfeited.
7.Disputes
Our decisions regarding Points
discrepancies will be final.
8.Program Changes
We may change or limit any aspect of the
Program; amend the Rules, benefits or
features, in whole or in part; may
discontinue or replace the provision of
prize draws with a similar reward of equal
or greater value; may modify, delete or
terminate any or all of the Program, the
Rules or any portion thereof, any or all of
the participating partners, rewards,
benefits, or special offers, at any time.
Changes may affect outstanding transactions
and Points and may include, but are not
limited to, the number of Points required to
be eligible for prize draw entries or any
other reward, the type of eligible
activities qualifying for Points, the type
of rewards, and the maximum number of Points
earned per month or year, or otherwise, if
applicable.
9.Limitation of Liability
Neither EnglishGathering.co.uk nor our
sub-contractors of either such party will be
responsible for indirect, special or
consequential loss, loss of profits,
economic loss, loss of goodwill or loss of
reputation in connection with or arising out
of the receipt (or non-receipt), ownership
(or non-ownership) or use of any reward. The
aggregate liability (whether in contract,
tort or otherwise) for loss or damage of
each of EnglishGathering.co.uk and its
sub-contractors will be limited to the
actual value of the prize (if drawn) or
other applicable reward in relation to any
claim or series of claims arising out of or
in connection with the receipt (or
non-receipt), ownership (or non-ownership)
or use of the prize (if drawn) or other
reward. We are not responsible for any
error, omission, interruption, deletion,
defect, delay in operation or transmission,
theft, destruction or unauthorised access
to, or alteration of Points accrued and
redeemed or other Program activities.
10.Notices
You agree to receive communications from
us electronically and that all agreements,
notices, disclosures and other
communications that we provide to you
electronically satisfy any legal requirement
that such communications be in writing. This
condition does not affect any applicable
statutory rights. We are not responsible for
delayed or lost correspondence, sent by post
or any other form of delivery, including
e-mail. You are responsible for ensuring
that you maintain a current email address
with us.
11.Law and Venue
These Rules will be governed by and
construed in accordance with the laws of the
United Kingdom, and the application of
the United Nations Convention on Contracts
for the International Sale of Goods is
expressly excluded. You agree, as we do, to
submit to the non-exclusive jurisdiction of
the courts of the United Kingdom. There
is no specific out-of-court complaint and
redress mechanism for the Program. If any of
these conditions is deemed invalid, void, or
for any reason unenforceable by a court,
that condition will be deemed severable and
will not affect the validity and
enforceability of any remaining condition.
